Our office handles a variety of insurance related matters, including disputes and issues relating to auto, homeowner’s, business, title, health and disability insurance. In the auto insurance arena, we frequently assist clients in dealing with property damage and personal injury claims resulting from auto accidents, including uninsured motorist and underinsured motorist claims. An uninsured motorist claim results when you suffer bodily injury as a result of the negligence of a driver of a motor vehicle that is not covered by a liability insurance policy or bond as required by the Missouri Financial Responsibility Law (every auto garaged in Missouri is required to have liability coverage with limits of $25,000 per person, $50,000 per occurrence and $25,000 for property damage). When this occurs, we assist you in making a claim against the underinsured motorist coverage in your own auto insurance policy (also required by law), which serves as a protection against other motorists who are without the required coverage. Underinsured motorist coverage is an additional non-mandatory coverage in Missouri that you may purchase as a part of the auto policy covering vehicles you own. This coverage protects you in the event you are involved in a collision with another person who has coverage that meets the minimum required of $25,000, but which is not sufficient to cover the damages and losses you have sustained in excess of this minimum amount. Again, we assist clients in making a claim under their own auto insurance policy for any additional benefits to which they may be entitled. In the homeowner’s area, we assist clients with disputes arising from claims made for losses covered or alleged to be covered under homeowner’s insurance policies, whether it be a fire loss that a company is dragging its feet in adjusting, or a weather related loss. We also assist clients who have disputes arising from claims submitted under their business insurance coverage for losses sustained to property used in association with a business. Although rare, we have assisted clients having claims against title insurance or escrow companies who have mis-handled real estate closings, or who have claims against other landowners relating to real estate boundaries, fences or other issues that may involve coverage under a title insurance policy. In the health and disability arena, we assist clients who have disputes over services or conditions covered by such policies, or disputes that occur when companies issuing such policies seek reimbursement from individuals who receive compensation from third party sources (such as another insurance company paying a settlement resulting from an automobile collision). This latter type of situation is referred to as a subrogation or reimbursement claim.
We have extensive experience in handling injury claims in both Missouri and Kansas, including those resulting in death, from auto collisions, railroad crossing collisions, auto-pedestrian collisions, slip and falls on commercial premises or property controlled by a governmental entity, dog bites, or injuries resulting from other forms of negligent conduct by individuals or businesses. We also handle injuries sustained at work (workers’ compensation claims). Many such violations may jeopardize your driving privilege and the right to drive a vehicle for years to come. Many if not most alcohol related offenses involve both an administrative component on the one hand (which relates to your license status and driving privilege with the State of Missouri) and a criminal component on the other (municipal or state court charges involving potential fines or imprisonment along with additional and related consequences for license status). We assist individuals and businesses involved in commercial and residential construction projects and disputes relating to construction or real estate development and leasing of real estate. We can help you avoid costly errors in dealing with contractors who are not properly insured or who do not pay their subcontractors who provide labor or materials for your construction project or personal home. A mechanic’s lien filed by a contractor or subcontractor can result in a homeowner or owner of commercial property having to pay for the same service twice, or risk having the real estate and improvements foreclosed in a mechanic’s lien action. We can also assist you to get what you paid for from contractors performing defective work, including incomplete work or non-conforming materials and work that does not satisfy building codes or private specifications.
